Taková činnost nebude posuzována jako „provozovaná samostatně podnikatelem vlastním jménem na vlastní odpovědnost“ tak, jak ji definuje zákon. Kromě možného výrazného finančního postihu (pokuty) také ztrácíte veškeré výhody vyplývající z pracovněprávního vztahu (zaměstnavatel vás může propustit bezdůvodně, nemáte nárok na placenou dovolenou a další) a nejste ani chráněni zákoníkem práce. Zároveň váš důchod bude s největší pravděpodobností nižší.
